1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Parkixo ("Parkixo", "we", "us" or "our") regarding your access to and use of the Parkixo platform and services.
By creating an account, accessing the Parkixo website, downloading or using the Parkixo application, making a booking, listing a parking space, or otherwise using the services, you agree to these Terms.
If you do not agree with these Terms, you must not access or use Parkixo.
2. About Parkixo
Parkixo is a technology platform intended to connect people seeking parking with individuals, businesses and other parking-space providers who make parking spaces available through the platform.
Unless expressly stated otherwise, Parkixo does not own, operate, manage or control every parking location listed on the platform. A parking space may be provided by an independent parking host or other third party.
Parkixo facilitates discovery, availability information, booking, payment and related platform functionality. The specific terms applicable to a parking space may also include information supplied by the parking host.
3. Eligibility
You must be legally capable of entering into a binding agreement to use Parkixo.
If you are using Parkixo on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for complying with all laws and regulations applicable to your use of the platform, your vehicle and your parking activities.
4. Accounts and Registration
Certain Parkixo features require you to create an account. You agree to provide accurate, current and complete information and to keep that information updated.
You are responsible for maintaining the confidentiality of your account credentials and for activities occurring through your account.
You must promptly notify Parkixo if you believe that your account has been accessed or used without authorization.
We may suspend or restrict an account when reasonably necessary to protect users, the platform, payment systems, parking hosts or Parkixo from fraud, abuse, security risks or violations of these Terms.
5. Parking Users and Bookings
A parking user may search for available parking spaces, review listing information, select an available time period, and submit a booking through Parkixo.
A booking is confirmed only when Parkixo or its applicable payment system indicates that the booking has been successfully confirmed.
Users are responsible for reviewing the parking space's location, operating hours, vehicle restrictions, access instructions, pricing, cancellation terms and other applicable listing information before completing a booking.
A booking is generally limited to the vehicle, date, duration and parking space specified in the booking.
You must not use a parking space for a purpose that is prohibited by the listing, the host, applicable law or these Terms.
6. Parking Hosts
A parking host is responsible for ensuring that it has the legal right and necessary authority to make a parking space available through Parkixo.
Hosts must provide accurate information regarding the parking space, including, where applicable, location, availability, pricing, access instructions, vehicle restrictions and material features or limitations.
Hosts are responsible for maintaining their listings and keeping availability and pricing information reasonably accurate.
Parkixo may review, modify, restrict, suspend or remove a listing when reasonably necessary, including where a listing appears inaccurate, misleading, unsafe, unlawful or inconsistent with platform requirements.
7. Parking Listings and Availability
Parking information on Parkixo may be supplied by hosts, partners or other sources. Although Parkixo may take reasonable steps to support accurate information, we cannot guarantee that every listing detail, photograph, description, availability status or feature is complete, current or error-free at all times.
A parking space may become unavailable due to circumstances outside Parkixo's control, including host changes, access restrictions, emergencies, maintenance or inaccurate availability information.
If Parkixo becomes aware that a confirmed booking cannot be honored, we may contact the affected user and provide an appropriate resolution in accordance with applicable cancellation and refund policies.
8. Prices, Payments and Taxes
Prices displayed through Parkixo may include the applicable parking charge, platform or service fees, taxes and other applicable amounts. The amounts payable will be presented during the booking or payment process where applicable.
Payments may be processed through third-party payment providers. By submitting a payment, you authorize the applicable payment provider to process the transaction using the payment method you provide.
You agree not to use fraudulent, unauthorized or otherwise invalid payment methods.
Hosts are responsible for their own tax obligations arising from amounts they receive through Parkixo, except to the extent Parkixo is legally required to collect, withhold or report taxes.
Parkixo may modify pricing, fees or payment arrangements from time to time. Changes generally apply prospectively and will not alter a completed booking unless required by law or necessary to correct an error.
9. Cancellations and Refunds
Cancellation eligibility and refund amounts may depend on the applicable booking, parking listing and cancellation policy presented to you at the time of booking.
Where a booking-specific cancellation policy applies, that policy controls the cancellation and refund treatment for that booking, subject to applicable law.
Pending bookings may be cancelled at any time before they are approved. Confirmed bookings cancelled 24 hours or more before the scheduled start time are eligible for a full refund. Confirmed bookings cancelled less than 24 hours before the scheduled start time are not eligible for a refund. No-show bookings are not eligible for a refund. If the host cancels a confirmed booking, the tenant will receive a full refund.
Approved refunds, where applicable, will be processed using the original payment method and may take 5–10 business days to appear, depending on your payment provider.
10. Check-In, Check-Out and Parking Rules
You must follow the access, check-in, check-out and parking instructions associated with your booking or provided by the parking host.
You must park only in the designated space or area and within the permitted booking period.
You must not block entrances, exits, driveways, emergency access, other vehicles or areas not included in your booking.
You are responsible for complying with posted parking rules, property rules, local traffic regulations and reasonable instructions from the host or property operator.
Additional charges may apply where permitted by the applicable listing or law for unauthorized parking, overstaying, damage or other violations.
11. Vehicle Information
You are responsible for providing accurate vehicle information when required for a booking, access or parking service.
The vehicle must comply with the vehicle type, size, clearance, weight and other restrictions specified for the parking space.
You are responsible for ensuring that your vehicle is legally registered, insured and operated by an appropriately licensed driver, as required by applicable law.
12. Prohibited Activities
You agree not to:
- use Parkixo for unlawful, fraudulent or deceptive purposes;
- provide false, misleading or materially incomplete information;
- create accounts for abusive, fraudulent or unauthorized purposes;
- use another person's account without authorization;
- interfere with or disrupt the operation or security of Parkixo;
- attempt to gain unauthorized access to systems, accounts or data;
- scrape, copy or systematically extract platform content without authorization;
- upload malicious code, viruses or other harmful material;
- use Parkixo to facilitate theft, illegal activity or other harmful conduct;
- misuse payment systems, promotions, referral programs or other platform features; or
- violate the rights of Parkixo, hosts, users or other third parties.
13. Reviews and User Content
Parkixo may allow users and hosts to submit reviews, ratings, comments, photographs and other content.
You are responsible for content you submit and represent that you have the necessary rights to submit it.
You must not submit content that is unlawful, defamatory, threatening, abusive, discriminatory, deceptive, invasive of privacy, infringing or otherwise inappropriate.
By submitting content to Parkixo, you grant Parkixo a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display and use that content as reasonably necessary to operate, improve and promote the services, subject to applicable law and our Privacy Policy.
Parkixo may remove content that violates these Terms or that we reasonably believe creates a risk to users, the platform or third parties.
14. Third-Party Services
Parkixo may integrate with or rely on third-party services, including payment processors, mapping services, messaging providers, authentication services, analytics providers and hosting or infrastructure providers.
Third-party services may be subject to their own terms and privacy policies. Parkixo is not responsible for third-party services except to the extent required by applicable law.
15. Intellectual Property
The Parkixo name, trademarks, logos, software, website design, application interfaces, graphics, text, databases and other platform materials are owned by or licensed to Parkixo and are protected by applicable intellectual property laws.
Except as expressly permitted by these Terms or applicable law, you may not copy, modify, distribute, sell, lease, reverse engineer or create derivative works from Parkixo's proprietary materials.
Nothing in these Terms transfers ownership of Parkixo intellectual property to you.
16. Service Availability
Parkixo may be unavailable from time to time due to maintenance, upgrades, technical problems, connectivity issues, security incidents or circumstances outside our reasonable control.
We may modify, suspend or discontinue portions of the platform or services when reasonably necessary.
17. Disclaimers
To the maximum extent permitted by applicable law, Parkixo provides the platform and services on an "as available" and "as is" basis.
Parkixo does not guarantee that the platform will always be uninterrupted, secure, accurate, complete or error-free.
Parkixo does not guarantee the condition, safety, legality, suitability, availability or security of a particular parking space beyond obligations that cannot lawfully be excluded.
Users should independently evaluate a parking location and follow applicable property, safety and legal requirements.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Parkixo and its officers, directors, employees, affiliates and service providers will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business, data or goodwill, arising from or related to your use of the platform.
To the maximum extent permitted by applicable law, Parkixo's aggregate liability arising from or relating to the services will be limited to the amount you paid to Parkixo in connection with the applicable transaction during the period permitted by applicable law.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
19. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Parkixo and its officers, directors, employees, affiliates and service providers from claims, liabilities, damages, losses and expenses arising from:
- your violation of these Terms;
- your misuse of the Parkixo services;
- your violation of applicable law or third-party rights;
- content you submit to Parkixo; or
- your use of or conduct relating to a parking space.
20. Suspension and Termination
You may stop using Parkixo at any time, subject to any outstanding obligations relating to existing bookings, payments or other transactions.
Parkixo may suspend or terminate your access to the platform if we reasonably believe that you have violated these Terms, engaged in fraudulent or harmful activity, created a security risk, or otherwise used the platform in a manner that may harm Parkixo or others.
Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, indemnification and dispute provisions, will survive termination to the extent permitted by law.
21. Privacy
Your use of Parkixo is also subject to the Parkixo Privacy Policy, which explains how we collect, use, disclose and protect information.
By using Parkixo, you acknowledge that you have reviewed the Privacy Policy.
22. Changes to These Terms
Parkixo may update these Terms from time to time to reflect changes to the services, legal requirements, security practices or business operations.
When material changes are made, Parkixo may provide notice through the website, application, email or other reasonable means.
The updated Terms will become effective on the date stated in the updated Terms. Your continued use of Parkixo after the effective date constitutes acceptance of the updated Terms, to the extent permitted by law.
23. Governing Law and Disputes
These Terms are intended to be governed by the laws applicable to Parkixo's operating entity and the applicable jurisdiction, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Before initiating formal proceedings, users are encouraged to contact Parkixo and attempt to resolve the matter informally.
Nothing in these Terms limits any mandatory consumer rights or remedies available under applicable law.
